Participation Agreement & Waiver.
Assumption of risk, release, medical authorization, concussion and heat-safety acknowledgments, payment terms, and electronic-signature consent.
Basketball and athletic-performance training can cause serious injury, permanent disability, paralysis, or death. This agreement contains assumption-of-risk and release language, including ordinary-negligence claims to the fullest extent permitted by Arizona law. It does not purport to release gross negligence, reckless or willful misconduct, intentional wrongdoing, or claims that cannot lawfully be released.
Authority and truthfulness
The signer represents that the signer is the participant’s parent or legal guardian, has authority to enroll the participant and sign this agreement, and has provided complete and accurate information. The signer will promptly update Kuwa Bora Basketball regarding changes that may affect safe participation.
Nature of activities and inherent risks
Basketball, strength and conditioning, speed and agility work, running, jumping, landing, cutting, lifting, resistance training, competition, games, drills, use of courts, weight rooms and training equipment, and travel or movement within facilities involve inherent and other risks. Risks include falls; collisions; contact with people, balls, surfaces or equipment; overexertion; dehydration; heat illness; concussion or other head injury; sprains; strains; fractures; dislocations; dental or eye injury; aggravation of known or unknown conditions; communicable illness; equipment failure; negligent acts or omissions of participants or third parties; serious injury; permanent disability; paralysis; and death. Not every risk can be listed or eliminated.
Voluntary participation and assumption of risk
Participation is voluntary. The signer and participant knowingly accept and assume all inherent risks and, to the fullest extent permitted by Arizona law, other risks arising from participation, whether known or unknown, foreseeable or unforeseeable, including risks arising from ordinary negligence of the Released Parties. This assumption does not apply to gross negligence, reckless or willful misconduct, or intentional wrongdoing to the extent such claims cannot lawfully be released.
Release and waiver
To the fullest extent permitted by Arizona law, the signer, for the signer and on behalf of the participant to the extent the signer may lawfully do so, releases and agrees not to sue Kuwa Bora Basketball, Sky Hood Ventures LLC, Coach Hood, facility owners and operators, landlords, contractors, coaches, staff, volunteers, agents, representatives, insurers, successors and assigns (the Released Parties) for claims arising from participation, including claims alleging ordinary negligence. This release is intended to be clear and conspicuous and does not release claims that Arizona law prohibits from being released.
Indemnity and responsibility for costs
To the fullest extent permitted by law, the signer agrees to defend, indemnify and hold the Released Parties harmless from third-party claims, liabilities, losses or expenses, including reasonable attorney fees, caused by the participant’s intentional misconduct, violation of safety rules, material misrepresentation or failure to disclose information, or damage to property. This provision is not intended to require indemnification for a Released Party’s gross negligence, reckless or willful misconduct, or intentional wrongdoing.
Health representation and duty to disclose
The signer represents that the participant is physically and medically able to participate or has obtained appropriate medical clearance. The signer will disclose allergies, medications, asthma, cardiac conditions, seizure history, diabetes, prior concussion, orthopedic limitations and other information reasonably necessary for safe participation. Kuwa Bora Basketball does not provide medical diagnosis, physical therapy or individualized medical treatment.
Emergency medical authorization
If the signer cannot be reached, the signer authorizes Kuwa Bora Basketball and facility personnel to provide first aid, use an automated external defibrillator if available and indicated, contact emergency services, and arrange transportation and emergency evaluation or treatment reasonably believed necessary. The signer accepts financial responsibility for resulting medical and transportation costs. This authorization does not create a duty to provide care beyond the training and resources reasonably available.
Concussion and head injury
The signer understands that concussion may occur without loss of consciousness and symptoms may develop later. A participant suspected of concussion or head injury may be removed immediately. The signer agrees to report symptoms and known head injuries promptly. The participant may not return the same day unless a qualified health care provider rules out concussion, and after a diagnosed or suspected concussion Kuwa Bora Basketball may require written clearance from a qualified health care provider before return.
Heat, hydration and environmental conditions
Arizona heat can cause dehydration, heat exhaustion, heat stroke and death. The participant must arrive hydrated, bring sufficient water, wear suitable clothing, follow rest and hydration directions, and immediately report dizziness, headache, nausea, confusion, chills, unusual fatigue or other symptoms. Kuwa Bora Basketball may modify, pause, relocate or cancel activity due to heat, air quality, facility conditions or safety concerns.
Rules, supervision and conduct
The participant will follow instructions, use equipment only as directed, act respectfully, avoid bullying or harassment, disclose pain or symptoms, and stop when instructed. Kuwa Bora Basketball may restrict, suspend or dismiss participation when reasonably necessary for safety, conduct, nonpayment, repeated disruption or program fit. A parent or authorized adult must comply with stated arrival, departure and pickup procedures.
Transportation and multiple facilities
Unless expressly agreed in writing, Kuwa Bora Basketball does not provide transportation. The parent or guardian is responsible for transportation, parking, safe arrival, pickup and movement between locations. Facility addresses and procedures may differ by class. Risks associated with transportation arranged by the family are not program activities controlled by Kuwa Bora Basketball.
Payments, attendance and program changes
Payment reserves limited capacity for the selected class and recurring weekdays. Except where required by law or when Kuwa Bora Basketball cancels and cannot provide a reasonable alternative, payments are non-refundable. Absences, withdrawal, travel, school conflicts, dismissal for conduct and missed sessions do not create an automatic right to refund, credit, transfer or makeup. Schedules, coaches and facilities may be reasonably changed, and equivalent alternatives may be offered.
Separate media choice
Participation is not conditioned on granting public media permission. Any authorization to photograph, record or publish the participant is a separate, optional decision. Declining public media permission will not prevent participation, though incidental appearance in wide-angle group or security footage may be unavoidable where legally permitted and reasonably managed.
Privacy and records
The signer authorizes collection and retention of information reasonably necessary for enrollment, safety, payment, incident response and legal compliance. Sensitive records are not sold to advertisers. Records may be disclosed to service providers, facilities, insurers, legal advisers, emergency responders or authorities when reasonably necessary or legally required.
Arizona law; venue; severability
This agreement is governed by Arizona law, without regard to conflict-of-law rules. Any action not subject to a valid arbitration agreement must be brought in a court of competent jurisdiction in Maricopa County, Arizona, to the extent permitted by law. If any provision is invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue in effect.
Electronic signature and entire agreement
The signer consents to electronic records and signatures and intends the typed signature, required initials, checkboxes, timestamp and associated electronic record to constitute the signer’s signature. This participation agreement, program terms and any separate written enrollment terms constitute the agreement concerning the subjects addressed and may be modified only in a writing accepted by Kuwa Bora Basketball and the parent or guardian.
Legal-review notice
This form is designed as a conservative Arizona-oriented operational agreement, but no template can guarantee enforceability. Arizona law may limit a parent’s ability to waive a minor’s claims, and assumption-of-risk questions may be decided by a factfinder. Kuwa Bora Basketball should obtain Arizona counsel review before relying on this agreement.
